Welcome to our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto developed by Web Commerce Communications Ltd or otherwise known as “WeWe” (collectively, the ”Site”), which offers you a marketplace and platform to engage with end users to offer them your services. These Terms and Conditions shall govern your access to the Site and the use of any services, information and functions made available by us at the Site (“Services”). Before using this Site or the Services, you must read carefully and accept the terms and conditions and policies herein contained pertaining to the use of the Site and/or the Services (referred to as these “Terms of Service”) and you must consent to the processing of your personal data as described in the Privacy Policy. By accessing the Site and/or using the Services, you agree to be bound by these Terms of Service and any amendments to the foregoing issued by us from time to time. If you do not agree to these Terms of Service and the Privacy Policy, please do not access and/or use this Site and/or the Services.
We assume that you are of the age of 18 or the legal age for giving consent hereunder pursuant to the applicable laws in Malaysia (the “legal age”), in order to register and open an account on the Site. We do not purport to provide the Services to any person below the legal age.

AGREEMENT TO TERMS
These Terms of Service (Freelancers) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and WeWe (“Company”, “we”, “us”, or “our”), concerning your access to and use of the Site.
You must read, agree to, and accept all of the terms and conditions contained in this Terms of Service to be a user of our website located at https://www.wewe.cc or any part of the rest of the Site.
This Terms of Service (Freelancers) includes and hereby incorporates by reference the following terms, which may be modified from time-to-time: Terms of Service, Privacy Policy, Refund Policy, and Standard Terms of Sale (Freelancers). We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service (Freelancers) at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Service (Freelancers), and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Service (Freelancers) to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Service (Freelancers) by your continued use of the Site after the date such revised Terms of Service (Freelancers) are posted.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site or use the Platform.

ACCOUNT REGISTRATION
By registering for an account to use the Site (an “Account”), by using the Site after changes has been made to these Terms of Service (Freelancers) if you had an Account on the date such changes are effected, you agree to abide by this Terms of Service (Freelancers) and the other relevant terms that are incorporated into these Terms by reference.
To access and use certain portions of the Site, you must register for an Account. You can register for an Account or add an Account type to use the Site as a Freelancer (a “Freelancer Account”). Subject to the Terms of Service, certain portions of the Site are available to site visitors, including those portions before your Account registration is accepted. We reserve the right to decline a registration to join our Site or to add an Account of any type (i.e., as an end user or Freelancer), for any lawful reason, including supply and demand, cost to maintain data, or other business considerations.
If you create an Account as an employee or agent on behalf of a company, you represent and warrant that you are authorized to enter into binding contracts, including these Terms of Service (Freelancers), on behalf of yourself and the company. Your privacy is important to us and your information will be handled in accordance with our Privacy Policy (which is part of these Terms of Service (Freelancers)), and applicable law.
You agree not to request or allow another person to create an Account on your behalf, for your use, or for your benefit, except that an authorized employee or agent may create an Account on behalf of your business. If any such authorized employee or agent violates these Terms of Service (Freelancers), it may affect your ability to use the Site.

ACCOUNT ELIGIBILITY
We offer the Site for your business purposes only and not for personal, household, or consumer use. To register for an Account or use the Site, you must, and hereby represent that you: (a) are an employee or agent of and authorized to act for and bind an independent business (whether it be as a self-employed individual/sole proprietor or as a corporation, limited liability company, or other entity); (b) will use the Site for business purposes only; (c) will comply with any licensing, registration, or other requirements with respect to your business, or the business for which you are acting, and the provision of all services performed for or delivered to end users by Freelancers (“Freelancer Services”); and (d) are either a legal entity or an individual who is 18 years or older (or have otherwise reached the age of majority in the jurisdiction in which you conduct business) in each case who can form legally binding contracts.

ACCOUNT PROFILE
To register for an Account to join the Site, you must complete a user profile (“Profile”), which you consent to be shown to other Users and, unless you change your privacy settings, to be shown to the public by default. You agree to provide true, accurate, and complete information on your Profile and all registration and other forms you access on the Site or provide to us and to update your information to maintain its truthfulness, accuracy, and completeness. You agree not to provide any false or misleading information about your identity or location, your business, your skills, or the services your business provides and to correct any such information that is or becomes false or misleading.

ACCOUNT USERNAMES AND PASSWORDS
Each person who uses the Site must register for their own Account. When you register for an Account, you will be asked to choose a username and password for the Account. You are entirely responsible for safeguarding and maintaining the confidentiality of your username and password.
You agree not to share your username or password with any person and, if you are a legal entity who is not a natural person, to only share your username and password with a person who is authorized to use your Account. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your Account or any unauthorized access to the password for any Account.

LIMITATION OF LIABILITY
We are not liable, and you agree not to hold us responsible, for any damages or losses arising out of or in connection with these Terms of Service (Freelancers), including, but not limited to:

your use of or your inability to use our Site;

delays or disruptions in our Site;

viruses or other malicious software obtained by accessing, or linking to, our Site;

glitches, bugs, errors, or inaccuracies of any kind in our Site;

damage to your hardware device from the use of the Site;

the content, actions, or inactions of third parties’ use of the Site;

a suspension or other action taken with respect to your Account;

your reliance on the quality, accuracy, or reliability of job postings, Profiles, ratings, recommendations, and feedback (including their content, order, and display), or metrics found on, used on, or made available through the Site; and
-
your need to modify practices, content, or behavior or your loss of or inability to do business, as a result of changes to the Terms of Service.
WeWe operates and manages the Site which connects the end users who require Freelancer Services with the Freelancers. WeWe itself does not provide any Freelancer Services. Any contract for the provision of Freelancer Services is solely between the end user and the Freelancer.
Additionally, in no event will we be liable for any special, consequential, incidental, punitive, exemplary, or indirect costs or damages, including, but not limited to loss of data, production, profit, or business opportunities. Under no circumstances shall the Platform Offering aggregate liability to the "End Users" or any third party arising out of or related to this ToS exceed any amount of fees paid by the "End Users" to the Platform Offering under the ToS regardless of the cause of action.

TERM AND TERMINATION
Either of us may terminate this Terms of Service (Freelancers) in our sole discretion, at any time, without explanation, upon written notice to the other, which will result in the termination of the other terms as well, except as otherwise provided herein.
In the event you terminate this Terms of Service (Freelancers), your right to use the Site is automatically revoked, and your Account will be closed. As we are not a party to any Service Agreement between users, you understand and acknowledge that termination of this Terms of Service (Freelancers) (or attempt to terminate this Terms of Service (Freelancers)) does not terminate or otherwise impact any existing engagement entered into between Users. If you attempt to terminate this Agreement while having one or more open engagements, you agree (a) you hereby instruct us to close any open engagements; (b) you will continue to be bound by this Agreement and the other Terms of Service until all such engagements have closed on the Site; and (d) you will continue to be obligated to pay any amounts accrued but unpaid as of the date of termination or as of the closure of any open engagements, whichever is later, to us for any Site or such other amounts owed under the Terms of Service (Freelancers) and to any Freelancers for any Freelancer Services.
Without limiting our other rights or remedies, we may, but are not obligated to, temporarily or indefinitely revoke or limit access to the Site, deny your registration, or permanently revoke your access to the Site to you if: (i) you breach any terms and conditions of this Terms of Service (Freelancers); (ii) we suspect or become aware that you have provided false or misleading information to us; (iii) we believe, in our sole discretion, that your actions may cause legal liability for us or our users; may be contrary to the interests of the Site; or may involve illicit or illegal activity; or (iv) we are required to by law.
If your Account is temporarily or permanently closed, you may not use the Site under the same Account or a different Account or re-register under a new Account without our prior written consent. If you attempt to use the Site under a different Account, we reserve the right to reclaim available funds in that Account and/or use an available payment method to pay for any amounts owed by you to the extent permitted by applicable law.

ACCOUNT DATA ON CLOSURE
Except as otherwise required by law, if your Account is closed for any reason, you will no longer have access to data, messages, files, or other material you keep on the Site and any closure of your Account may involve deletion of any content stored in your Account for which we will have no liability whatsoever. To the extent permitted by law, we may retain some or all of your account information.

GOVERNING LAW
These terms shall be governed by and defined following the laws of Malaysia. You irrevocably consent that the courts of Malaysia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SITE. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances. or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records. or to payments or the granting of credits by any means other than electronic means.
